Khiyar al-Bulugh a Year and a Half after Reaching Maturity
Question
(1) Can a minor girl obtain the annulment (faskh) of her nikah a year and a half after reaching maturity? The boy was willing to give the girl talaq before reaching maturity. Now he neither gives talaq nor calls the girl to him. The nikah took place in the state of minority. (2) Can this girl’s second nikah after talaq take place at once, after a few days, given that she has not even gone to her husband’s home?
Answer
If someone other than the father and the grandfather gave her in marriage, then immediately upon reaching maturity she has the right to reject this nikah, making witnesses to that, and to have it annulled by a Muslim ruler who acts in accordance with the Shari‘a.
