Picking Up Fruit Fallen from Someone’s Tree

Question

Zayd has a small orchard with trees. A crow sat on a tree and knocked a fruit down from it; that fruit is lying under the same tree. Now if someone picks up this fruit and eats it, is that permissible or not?

Answer

Because of this falling, the fruit has not left Zayd’s ownership; taking it and eating it without the owner’s permission is not permissible.
