Question: What is the ruling on taking a brokerage fee from both the seller and the buyer?

Answer

Brokerage from both sides is permissible when there is a custom (‘urf) for it. In principle the brokerage transaction is impermissible, but the jurists (fuqaha) have permitted it on the basis of need and custom, and this permission, by virtue of its generality, covers everything, one-sided and two-sided alike. Thus in al-Shami, Kitab al-Ijara.
