The Ruling on One Who Does Not Accept Fiqh
Question
A certain person calls himself a scholar (‘alim) and a hafiz. Concerning a certain fatwa he says: “The answer has been given from the books of fiqh, therefore the answer is not correct, because fiqh is nothing, and I do not accept it.” Is his statement correct, and what is the ruling on this?
Answer
Denying fiqh is the work of those who do not follow a madhhab; one must never say such a thing. Fiqh, too, is established from the Holy Qur’an, the noble Hadith and the reports (athar) of the Companions ﵃, and the denial of fiqh necessarily entails the denial of all of these.
