Buying Unripe Fruit on Condition of Picking It from the Seller’s Tree
Question
There is this condition: when the mangoes, while unripe, are fully developed, the buyer is to detach them from the tree and vacate the tree, and not ripen them on the tree. And if he ripened them on the tree, as is the custom here, what is the ruling on the buying and selling of this fruit?
Answer
This condition is correct. If, after a valid transaction, the seller has given permission for them to remain hanging on his tree, it is permissible.
